Ad Hoc Study Committee on Estate Planning Conflict of Interest

 The Ad Hoc Study Committee on Estate Planning Conflict of Interest is considering legislation relating to lawyers being named as a personal representative or other fiduciary position in connection with a client's estate planning. 
 
The Committee previously drafted legislation relating to gifts to lawyers by clients, which was enacted by the Florida Legislature.
 
The Committee also continues to monitor ethical developments relating to estate planning lawyers, including the Florida Supreme Court's recent amendments to Florida Bar Rule 4-1.8, effective February 1, 2018, regarding client gifts to lawyers and lawyers serving as fiduciaries in documents which they draft.
