Ad Hoc Guardianship Law Revision Committee

The Committee proposed a complete re-write of the chapter of Florida Statutes governing guardianship, proposed as Chapter 745.  That proposal was passed by the Executive Council of the Section in 2020.  In 2021, the Committee considered and incorporated many of the additional comments received by other stakeholders and a redline version of the proposal, reflecting those changes appears in the Committee Materials.  That redline version is the most current version of the proposal.
 
Mission Statement: The mission of the RPPTL Chapter 745 Committee is to revolutionize Florida’s guardianship landscape by establishing a single, unified statutory chapter that ensures consistency across all judicial circuits. We aim to refine existing laws to eliminate inefficiency, reduce costs for Florida citizens, and enhance the quality of care and oversight. Above all, our work is anchored in the protection of individual liberty, ensuring that the highest standards of due process and fundamental rights are integrated into every facet of the guardianship process.
