Back in spring 2025, the Real Property Problem Study Committee tackled a question that had sparked spirited debate throughout the Section: when a covenant appears in a deed or easement, who is bound by it down the chain of title? The discussion featured some of the brightest minds in Florida real property law and left no shortage of differing views.
Now, the Florida Supreme Court has weighed in with RJ International. While the Court held that an attorney’s fees provision does not run with the land, the opinion raises new questions about Hayslip, the Restatement, and the future treatment of deed restrictions and covenants. The decision will affect how lawyers draft documents, advise clients, and evaluate risk for years to come.
So we’re getting the band back together. Under the leadership of current Section Chair John Scuderi, past Section Chairs Peggy Rolando and Michael Gelfand return with others, with Rob Freedman moderating. Expect thoughtful analysis, differing perspectives, and the collegial debate that made the first program so memorable.
Join us at the Real Property Problem Study Committee, Friday, 11:00 a.m. to 12:00 p.m., right before lunch, at Royal 2, 3, 4 or on Zoom at https://us06web.zoom.us/j/
