Probate & Trust
Ad Hoc Jurisdiction & Service of Process

This Committee proposed legislation, which was passed by the Florida Legislature in 2013, designed to create specific criteria for jurisdiction in Florida for trusts with parties, including fiduciaries, who are out-of-state (essentially, the trust equivalent of a long-arm statute).

The Committee is currently proposing an amendment to F.S. Chapter 731 to provide that formal notice as provided in the Florida Probate Rules does not confer in personam jurisidiction over persons receiving formal notice.
